Portland businessman Everton 'Beachy Stout' McDonald and his co-accused Oscar Barnes were on Monday morning slapped with an additional charge of conspiracy to murder in the death of Mr. McDonald's wife, Tonia.
This comes after presiding judge Justice Chester Stamp refused an application by the prosecutor to have the indictment amended on February 6.
Justice Stamp accepted another application filed Monday after initially denying the prosecution's attempt to have the indictment reflect that Denvalyn 'Bubbla' Minott conspired with Barnes to carry out the murder, and that Minott conspired with Mr. McDonald.
Justice Stamp said the amendment is necessary in the circumstance of the case and that no injustice can result from the amendment.
Minott is serving 19 years in prison for his role in the murder.
