Lawyers representing Joseph Patterson, President of the United Independents' Congress (UIC), have filed a motion before the Supreme Court challenging the constitutionality of the Disaster Risk Management Act (DRMA).
The lawsuit was filed on Monday.
Mr. Patterson's attorney, Hugh Wildman, told Radio Jamaica News that the motion was served on the Attorney General.
He said a motion challenging the Public Order Act, which restricts marches and the movement of persons is also being challenged.
In the lawsuit, filed in response to the arrest and charge of Mr. Patterson and three others for breaches of the DRMA on September 22, Mr. Wildman is claiming that the Act is unconstitutional as it violates Section 20 of the Charter of Fundamental Rights and Freedom.
He said the measure restricting the movement of persons is illegal.
Mr. Patterson was accused of arranging an unauthorised march on Gordon House to protest the government' lockdown measures.
The government has been using the Disaster Risk Management Act to restrict movement as part of measures to control the spread of the coronavirus.
