Security guards' contract case goes to Supreme Court on Friday

UCASE President Vincent Morrison

The legal showdown between security guards and their employers regarding controversial contracts being offered to them will switch to the Supreme Court on Friday.

The Union of Clerical Administrative and Supervisory Employees [UCASE] says the legal challenge is to ensure the rights of security guards are protected.

UCASE President Vincent Morrison is hopeful that the court will rule in favor of the guards.

"That contract that they were asked to sign, that extinguished all of their rights, prioro to the Justice Batts ruling, we feel that that contract is not only unconsionable; it is wrong, and therefore we are hoping that the court will make a declaration, with respect to that arrangement."

The Supreme Court ruled in September 2022 that the security guards were not independent contractors, but instead employees entitled to all attendant benefits.

Since then, a number of the guards have rejected new contracts given to them by their employers, arguing that they will lose benefits accrued over the years.
