The Fair Trading Commission (FTC) has discontinued its investigation into the purchase by Cable & Wireless of Columbus Communication, which operates Flow.
The FTC said on Monday that it had decided to end the investigation, based on a judgment delivered by the Court of Appeal in December.
The court held that the FTC has jurisdiction over telecommunications matters and all agreements that are likely to be anti-competitive. It also ruled, however, that the FTC does not have such jurisdiction over agreements relating to the transfer of a telecommunication licence which has been approved under the Telecommunications Act.
