A legal showdown is looming following the sale of lands by SCJ Holdings to a property developer, for which it supposedly had no legal right.

The parcel of land in question is owned by the Anglican Church in Jamaica and utilised by the St. Catherine based McCook Primary and Infant school.

Documents obtained by Radio Jamaica News reveal that the land was transferred to the Anglican Church in 1939 by Edwin Charley and was used by the Church and school.

The developer has excavated a portion of the property, including the playfield which the school had been using, and designed it for road and housing units.

Maurice Anderson, General Manager of the property management group of the Anglican Diocese of Jamaica, said instructions have been given to seek legal redress.

"We did have some discussions with the developer who was willing to give us back the property but they have since changed their mind. We have spoken to our attorneys and they are taking action. Right at this moment I can't say exactly what that action is, but we are trying to recover the land as we speak," he said.

Mr. Anderson is optimistic that the property will revert to the Church.

With significant development taking place in the area, Mr. Anderson said the school will eventually need to be enlarged, and the land in question would be ideal.

"The school needs a playing field and also just because of the number of people that will be out there, we will have to take in more people in that school. So we are hoping that we will get back the property."
