Maurice Tomlinson
The Appeal Court has reserved judgement in the legal battle involving gay rights activist, Maurice Tomlinson as well as Television Jamaica and CVM.
The panel of judges reserved their decision after lawyers for the parties wrapped up submissions in the case on Tuesday.The Appeal Court said it will hand down its decision in July.
Tomlinson challenged a 2013 ruling by the Supreme Court which rejected his lawsuit against the television stations.
He then sued TVJ and CVM, claiming discrimination and breach of his constitutional rights when the stations refused to air a commercial about tolerance for gays.
The attorneys for TVJ strongly defended the action of the station arguing that it had the constitutional right to determine the editorial content that is aired.
They further argued that as a private entity TVJ has the right to reject any content and cannot be compelled to air the commercial.
