Angry residents affected by the latest chemical spill in the Rio Cobre in St. Catherine, are initiating legal action against the National Environment and Planning Agency (NEPA) to force it to use its regulatory powers.
Effluent from bauxite company Windalco's Ewarton plant polluted the river and caused a major fish kill on the weekend.
Kestonard Gordon, Vice-Chairman of the St. Catherine Parish Development Committee, speaking on Radio Jamaica's Beyond the Headlines, that the residents want the court to compel NEPA to enforce regulations for past breaches which caused pollution.
He said legal action has been long in the making.
The claim is that NEPA had information and evidence of breaches in the past which caused it to take court action.
However, the residents believe this is not enough as NEPA has powers under the law which it has failed to use.
