The Industrial Disputes Tribunal (IDT) has ruled that two employees of the Runaway Bay Heart Hotel who were terminated nearly two years ago be reinstated. They have also been awarded payments.
According to the National Workers Union (NWU), the employees' services were terminated in July 2011 for an alleged breach of the hotel's rules. However, the union said the offence did not warrant the workers' termination and took the matter to the IDT.
The Tribunal's ruling states that the employees must be given back their jobs and paid 40 weeks’ salary. If the reinstatement is not done by April 30, they should be given 80 weeks’ pay. This was confirmed by NWU Vice President Howard Duncan.
He told RJR News that, arising from the disciplinary breach that occurred, the company was to have issued letters of suspension but instead it terminated the workers' services. The matter was taken by the union first to the Ministry of Labour and then to the IDT. There were 11 sittings of the tribunal before the ruling was made.
"The workers are elated and are now understanding that justice is some place if we only seek for it,” said Mr. Duncan.
