PNP's Dayton Campbell wins defamation lawsuit against Karen Cross

General Secretary of the People's National Party (PNP) Dr. Dayton Campbell has won his legal battle against former party activist Karen Cross.
 
A Supreme Court judge on Friday ruled in favour of Dr. Campbell in his multi-million dollar defamation suit filed against Ms. Cross.
 
The matter is now set for assessment to determine the amount of damages to be awarded to Dr. Campbell.
 
Dr. Campbell had filed a lawsuit against Ms. Cross and two other women, including a blogger, in 2022, claiming that the defendants published defamatory words in relation to him, using email and the social media platforms YouTube and Facebook. 
 
In his application, the PNP General Secretary had asked that the defences of each of the three defendants be struck out, that judgment be entered against them and that damages be assessed.
 
He also applied for a permanent mandatory injunction directing the removal of the social media posts which alleged grave misconduct by him.
 
Lawyers for Dr. Campbell had referenced a letter dated March 16, 2021, which was published by Ms. Cross, that contained damaging claims against him.
 
He claimed he was defamed by the letter distributed in Jamaica and worldwide by email and on social media including Facebook.
 
After hearing the application by Dr. Campbell, the judge rejected the defence of Ms. Cross and the other two defendants.
 
The judge found that allegations made by Ms. Cross were defamatory as she failed to back up her claims with any evidence or witness statements.
 
The judge also pointed to a report by the police that they found no evidence of the claims made by the political activist, who was expelled from the PNP in 2021.
 
The next step is for damages to be assessed. 
 
The judge also ordered that the claims posted in social media by Ms. Cross be removed immediately and that the three defendants are restrained from publishing or communicating by social media or any other media, any further words of the same or similar content as the videos and posts which were the subject of the claim.
