Prosecutors on Friday acknowledged that if the Court of Appeal orders a retrial of dancehall entertainer Vybz Kartel and his three co-accused, there would likely be a breach of their constitutional right to a fair trial within a reasonable time.
But they argued there are possible remedies which would allow a retrial to go ahead.
The concern about possible breaches of the constitutional rights of the accused men in the event of a retrial has been an important issue in this Court of Appeal hearing.
But Prosecutor Lorienn Tugwell argued that in the event of a breach, the next step is to look for remedies.
She argued that a dismissal of the case because of delay has to be the last resort.
She said that did not need to be the case since the court has the option of ordering an expedited trial or granting bail.
Bail had also been suggested earlier as a possible remedy for the complaint that Kartel is suffering mentally and physically from the ordeal of the case.
The Court of Appeal is seeking to determine whether Kartel - whose real name is Adidja Palmer - as well as Kahira Jones, Andre St. John and Shawn Campbell should be retried for the murder of Clive 'Lizard' Williams.
The Court will hear closing arguments next week.
