Unconstitutional: Court rules in favour of five men detained under SOE

Supreme Court Justice Bertram Morrison this morning ruled the detention of five men under states of emergency to be unconstitutional.

The five men had been detained in States of Emergency in Westmoreland, St. Andrew South and east Kingston.

The judge said the men's constitutional rights and the constitution itself were breached by what he called the current system of executive detention.

He also ruled that the use of detention orders for criminal offences could not be countenanced.
