Waterfalls says its not in breach

The operators of Waterfalls restaurant and nightclub in Liguanea, St Andrew have taken issue with statements made by Mayor of Kingston Desmond McKenzie.
       On Monday, the Mayor named the club among a list of entities that he claimed were in breach of the council's fire and safety regulations.
The Mayor had announced that the entities had 14 days in which to regularise their status with the council or face sanctions.
But today, Owner of Waterfalls Trevor Randle faxed our newsroom, copies of certificates issued to the establishment by the Jamaica Fire Brigade as well as a fire and peril insurance document from the Jamaica International Insurance Company.
The certificates expire on October 26 this year and March 31 next year respectively.
Mr. Randle also told our news centre that the club has not yet received notice of the 14-day ultimatum from the KSAC.
In relation to the Places of Amusement license, Mr. Randle told our News Centre that the club has paid the requisite fees every year since it was established but to date has not received a license.
“We have never received a Place of Amusement License and we have done everything that we are supposed to do to comply with the requirements and one reason that was cited is that neighbors have complained about noise and we have spent millions of dollars rectifying that just to appease the KSAC to Randle and to hear this now is really disappointing.” said Mr. Randle.
He admitted that the club had not yet sent formal notification of the remedial work to the council but said he would be writing to the Mayor.
However, Mayor McKenzie dismissed the complaint by Waterfalls and insisted that the establishment is not yet in compliance with KSAC rules.
“We are not satisfied that they have done so..., as a matter of fact, our technical people are still awaiting them to advise what they have done...let me advise those who want to be contentious, the law is quite clear, you cannot operate a place of amusement without the proper certification and licensing from the KSAC, I am standing by what I said and I am challenging anyone to say otherwise.” the Mayor said.
