Constable Noel Maitland's lawyers abort bail application

The legal team representing Constable Noel Maitland, who is charged with the murder of his girlfriend Donna-Lee Donaldson, on Wednesday morning aborted its renewed bail application in the Home Circuit Court.
 
When the matter was called up, the prosecutor told the court that the defence, in a letter dated November 9, indicated that it will not be pursuing the application and will be focusing on the completion of the case file for trial.
 
As it relates to the case file, the prosecution told the court that statements from three witnesses are not forthcoming and the matter will proceed without them.
 
The prosecution is to disclose the list of witnesses it intends to rely on within the next 14 days.
 
Mr. Maitland's attorney Christopher Townsend questioned why it is taking the prosecution one year and six months to make a determination on witnesses they intend to call.
 
But presiding Judge Justice Vinnette Graham told Mr. Townsend put his question in writing and direct it to the Director of Public Prosecutions for a response.
 
Mr. Maitland was subsequently remanded until January 17, 2024 for plea and case management hearing. 
 
Prior Wednesday's adjournment, Mr. Maitland, through his attorney Christopher Townsend, complained that he has been victimised.
 
Mr. Townsend said his client instructed him to inform the court that he has been affected by the actions of a sergeant in the case.
 
But after hearing the claim, Justice Vinette Graham-Allen told Mr. Townsend that she is not in charge of the sergeant or lock-ups.
 
The judge told Mr. Townsend that he should direct his client's complaint to the Commissioner of Police.
 
She also chided Mr. Maitland for having his attorney raising the claim in court given the fact that he is a police officer and would be aware of the various channels to direct his complaint.
