immigration attorney, George Crimarco, Monday testified that persons holding a United States passport have automatically sworn
or affirm allegiance to the United
States.
Mr. Crimarco was giving testimony Monday at the election petition hearing in which defeated People's National Party (PNP) candidate Abe Dabdoub is seeking to unseat the West Portland Member of Parliament Daryl Vaz.
Mr. Dabdoub has asked the High Court to remove Mr. Vaz, claiming he holds dual citizenship and is therefore disqualified from sitting as an Member of Parliament as outlined in the constitution.
Mr. Vaz admitted that he is a US citizen but says he received the citizenship through his mother.
He denied taking the US oath of allegiance.
But in testimony Monday, Mr. Crimarco who was called as an expert witness by Mr. Vaz told the hearing that persons holding US passports owe allegiance to the United States.
Mr. Vaz recently testified that he uses his US passport when he travels abroad.
During Monday's hearing, Mr. Dabdoub's attorneys submitted a US High Court judgement which held that once a person tenders a US passport this proves that the person holds allegiance to the United States.
The judgement further states that the holding of a US passport is a declaration and an admission that the person is a subject of the United States.
The hearing continues Tuesday.
