A decision is to be made on Friday in the St. James Circuit Court on the parish to which the Mario Deane case will be transferred for trial.

Supreme Court judge, Justice Bertram Morrison, who is hearing the case in the St. James Circuit Court, has recommended that the matter be tried outside of the parish following delays in the empanelling of jurors.

The case is expected to be transferred to either St. Ann, Westmoreland or Trelawny.

Three police officers are to be tried in connection with the beating death of Mr. Deane in 2014.

Corporal Elaine Stewart, Constables Juliana Clevon and Marlon Grant are charged with manslaughter, perverting the course of justice, and misconduct in a public office.

Mercia Frazer, the mother of Mario Deane, has expressed optimism that she will receive justice for the death of her son while in police custody.

"The expectation that I came with before say, yeah, they going put it off again and again. Now, it seems like something's going to happen and I am open and I am waiting. I am anxious to see what [will] happen. Well, tomorrow, I guess we'll have that decision exactly where. So tomorrow, morning we'll be here again to hear. They're going to do their duty and hopefully we'll get something done," she said on Thursday.

Ms. Frazer accused the police of deliberately delaying the process.

"I'm not expecting much of them doing anything to get this thing going because as far as I'm concerned, I think they're purposely doing it so that I get fed up and just don't worry come like a lot of families. They just don't worry come. And that's what I think they are doing it for," the woman argued, while pointing out that the 10-year delay is also bad for the cops implicated in the case.

Mr. Deane was beaten on August 3, 2014 while in custody at the Barnett Street Police Station, in Montego Bay, St. James.

He died three days later at Cornwall Regional Hospital.
