Rick's Cafe boss freed of DRMA charges

The CEO of Rick's Cafe in Negril, Westmoreland, Thomas Martin, was freed on Friday of charges brought against him under the Disaster Risk Management Act a year ago.
 
The charges stemmed from the holding of a party, Mocha Fest, during the COVID-19 lockdown.
 
When the matter came up in the Westmoreland Parish Court, Mr. Martin's attorneys, Peter Champagnie and Javed Grant, submitted that the prosecution failed to make a case against their client. 
 
In addition to referring to a number of irregularities with the process which led to Mr. Martin being charged, the attorneys argued that he could not have been liable as he was not at Rick's Cafe when the event was held.
 
This was supported by the testimony of one of the witnesses for the prosecution.
 
The judge accepted the submissions and instructed that Mr. Martin be released.
