Attorneys for convicted sniper Lee Boyd Malvo will on Wednesday argue before a Circuit Court that his six Montgomery County, Maryland, murder convictions should be vacated.
The Jamaican was convicted in 2006 for the crimes.
In August 2022, Maryland's Court of Appeals, now known as Maryland's Supreme Court, ruled that in compliance with the standards of the US Supreme Court, the Circuit Court must re-sentence Malvo.
Malvo was 17 when he and John Allen Muhammad, who was 41, began the attacks in D.C., Maryland and Virginia for a period of three weeks in October 2002.
The attacks left 10 people dead and three others critically wounded.
Since the 2022 ruling by the appeals court, Judge Sharon Burrell has held periodic hearings to discuss logistics of Malvo's re-sentencing for his Maryland crimes.
The husband of one of the Maryland victims has filed a motion opposing the idea of vacating Malvo's current convictions.
