The Caribbean Court of Justice (CCJ) will on Monday begin hearing a case involving Dominica-based company, DCP Successors Limited and the Jamaican Government.
The Trinidad-based CCJ will be conducting the hearing in its original jurisdiction.
In this jurisdiction, the Court has exclusive authority to adjudicate upon disputes arising from the interpretation and application of the Revised Treaty of Chaguaramas, which governs the operation of the CARICOM Single Market and Economy.
The soap manufacturing company filed a complaint with the CCJ alleging that Kingston is violating the provisions of the Revised Treaty of Chaguaramas as it pertains to the manufacture of soap.
DCPS uses a process called saponification to make generic soap noodles which can then be scented and moulded.
It contends that the Jamaica Government is breaching the provisions of the Revised Treaty of Chaguaramas by exempting its soap manufacturers from paying the Common External Tariff on imported soap noodles which do not qualify for community treatment as imported products.
The CCJ, says the matter represents its first in-person hearing since the start of the COVID-19 pandemic.
