Hay-Webster’s attorneys vow to fight move to oust her from Parliament

    Lawyers representing embattled South-Central St. Catherine Member of Parliament, Sharon Hay-Webster, say they will be fighting the application by the Jamaica Labour Party to have her ousted from the House of Representatives, in the dual citizenship impasse.

    The first round in the legal battle between Mrs Hay-Webster and the JLP's Devon McDaniel was adjourned Thursday before the Supreme Court.

    In February, the attorneys for Mrs. Hay-Webster had applied to the court to strike out the motion filed by Mr. McDaniel to remove her from the House of Representatives.

     However, the court was informed that Mrs. Hay-Webster hired new attorneys who needed more time to prepare their case.

     The hearing is now scheduled to begin in the new court term which starts in September.

     Mrs. Hay-Webster’s attorney, Ian Wilkinson, told RJR News that the embattled St Catherine MP will not yield in her fight to remain in the House of Representatives.

     According to Mr. Wilkinson there are important constitutional issues involved in the South Central St. Catherine MP's dual citizenship case.

     He said she will continue to resist any attempt to remove her as MP, adding that all the legal issues surrounding her status must be properly ventilated by the Supreme Court.

     Mrs. Hay-Webster is being challenged by Mr. McDaniel, concerning her nomination and election as the representative for the constituency.

    Mr. McDaniel's legal team has argued that because she has a United States passport as an adult, it means she would have taken an Oath of Allegiance to that foreign state.

    His lawyers are insisting that Mrs. Hay-Webster be disqualified from sitting as an MP.

    However, Mrs Hay-Webster has publicly declared that while she was born in the United States she has only sworn allegiance to Jamaica.

     The Parliamentarian recently resigned from the Peoples National Party over the issue and now sits in Parliament as an independent member.
