Attorneys for the Jamaica Association of Composers, Authors and Publishers (JACAP) have dismissed a claim by the lawyer for a local cable company that it lost the first round in a legal battle to collect fees from local cable providers.
JACAP had sued Manchester-based Mars Cable Company and its owner Marlon Allen for failing to pay fees for using overseas content.
Attorney-at-law Chuck Cameron, who represents the company, said JACAP lost the case after it failed to convince the judge that it represented overseas content providers.
But Attorney Christopher Henry of the law firm Samuda and Johnson said this is not so.
"We have filed our affidavit and all the 28 agreements he has referred to have been filed before the court as well as the particulars of music or copyrighted material that has been allegedly infringed. Therefore, the claim still survives and the cable company he represents still owes us our fees for the use of copyrighted music," he contended.
