NEPA interdicts officer in relation to Charlemont Drive development probe

Radio Jamaica News has been reliably informed that the National Environment and Planning Agency (NEPA) has interdicted one of its officers in relation to the investigation into breaches at the Charlemont Drive development.
 
The development, located at 11 Charlemont Drive, is owned by President of the National Water Commission Mark Barnett and his wife, Annette Francis-Barnett.
 
It became the subject of an investigation by the Integrity Commission and subsequent ruling by the Director of Public Prosecutions.
 
The DPP ruled that the couple cannot be prosecuted for breaching the environmental permit for their development as the time has expired.
 
Ms. Llewellyn said given that the breach was first identified by the National Environment and Planning Agency on December 17, 2020, prosecution should have been initiated by December 17, 2021.
 
She further noted that there were discrepancies in the findings reported by NEPA and the Kingston and St. Andrew Municipal Corporation (KSAMC) into breaches uncovered at the development.
 
The DPP said the officer from NEPA observed and noted a breach on December 17, 2020, however, seven days prior, an officer from the KSAMC visited the location and determined that the building structure was compliant with plans approved by the local authority.
 
She said the disparity between the two agencies cannot be overlooked, adding that actions of public officials performing their duties must be beyond reproach to inspire public trust.
