The National Environment and Planning Agency (NEPA) has submitted a file to the Office of the Director of Public Prosecution for a ruling on whether charges should be pursued against Batteries and Accessories Warehouse for oil contamination.
NEPA says it has taken steps to have Batteries and Accessories remediate areas contaminated by oil at its Great George Street location in Savanna-la-Mar, Westmoreland.
The agency says upon learning of the oil contamination, it served the business operator with a site warning notice and subsequently with an enforcement notice requiring that they take steps to address the matter.
It said the oil spill is suspected to have flowed from the company's warehouse after it was engulfed in flames earlier this year.
The warehouse stored items such as engine oil, gear oil, lubricants and batteries, and the escaped oil was said to have ended up in a nearby drain.
According to NEPA, the presence of the oil was not immediately detected and only became evident after the area began experiencing constant rainfall which caused the drain to overflow and the oil to rise to the surface.
NEPA says it is finalising its investigation.
