Attorney Bert Samuels

Bert Samuels, the attorney representing the Police Federation, has maintained that the new penalty changes for officers who breach the Constabulary Force Act are egregious.

Speaking on RJR's Hotline on Thursday morning, Mr. Samuels said members of the Jamaica Constabulary Force now face a $250,000 fine if they are convicted for breaching the Act. The previous fine was $20.

"Whereas in the law before the amendment you only would be sent to prison if you didn't pay the $20, this time the judge can fine or confine you and the judge may say 'I'm not going to impose a fine at all, I'm going to send you straight to prison'. That's now possible because there is a disjuntive 'or' in that amendment," the attorney contended.

National Security Minister Robert Montague and the Police Federation are still locked in a meeting that was convened following disquiet among members of the Federation regarding amendments to the Force Act.
