Prime Minister Dr Andrew Holness has confirmed that the by-election for the Seiverwright Gardens division announced for September 3 will not be held that day.
Mayor of Kingston Andrew Swaby had complained that the proper procedure for scheduling the by-election was not followed.
These include the notice of resignation, publication of the notice in the daily newspapers and consultation between the chairman of the Municipal Corporation and the Chief Electoral Officer.
Dr Holness addressed the issue on Monday following his nomination in the constituency of St Andrew West Central.
He conceded that "the law gives the authority to call a by-election when there's a vacancy, to the mayor," but added that "the mayor was not so minded,"which made it impossible to have the election for the seat in the Kingston & St. Andrew Municipal Corporation.
