Hi-Pro Feeds and horse owners head to court

The ongoing saga between feed producers Hi-Pro and disgruntled owners and trainers over the death of more than 30 horses and the poisoning of 75 more at Caymanas Park in May this year, is headed for the courts.

That's the word of attorney Rudolph Muir who represents 15 owners and trainers for 29 of the 75 claims.

Muir said offers received on November 29 from the British loss adjusters representing Hi-Pro, have been rejected on the grounds of being unrealistic and unrelated to the true costs borne by owners and trainers.

“I expect that the first suit will be filed between Wednesday to Friday of next week. They are moving very, very aggressively now because Hi-Pro needs to come back to the table, if those suits are to be discontinued. It cannot be that seven months after an incident like this and recall this is the largest case, largest recorded case of toxicosis by this substance”, Muir commented.

Vice President of Hi-Pro feeds Ian Parsard, who spoke with RJR Sports from Miami on Thursday, expressed disappointed that Muir is trying the matter in the public domain.

However, Parsard says Hi-Pro stands ready to deal with the matter in the courts.

“If it is that a claim has been submitted as one position, and the insurance had another position then maybe the best way to arbitrate is to get the court to arbitrate”, he mentioned.

Meanwhile, Parsard re-affirmed Hi-Pro's commitment to settle all valid claims by owners and trainers who suffered losses as a result of the contaminated feed in May.
