Digicel employee sues company over its COVID vaccine mandate

Telecommunications company Digicel Jamaica is facing legal action from one of its employees for the recently announced COVID-19 vaccination mandate.
 
The employee, Doric White, a senior data specialist at Digicel, has sought an injunction from the Supreme Court to block the implementation of the company's vaccination policy. 
 
Mr. White filed a urgent notice for court orders on Wednesday.
 
He cited breaches of his fundamental rights and freedoms under Jamaica's Constitution and breaches of his employment contract with Digicel.
 
Mr. White, who has been an employee of Digicel since September 1, 2015, is seeking a declaration from the court that the company's vaccination policy is in breach of his employment contract.
 
He wants to obtain the injunction to, among other things, prevent Digicel from implementing the policy, withholding his salary, demoting him or taking any action that would have an adverse effect on his employment, or firing him for not complying with the vaccine mandate.
 
Digicel imposed a vaccine mandate for its workers in September.
 
It gave employees until October 15 to get vaccinated or be required to prove, through the provision of PCR test results every two weeks, that they do not have COVID-19.
 
News of the legal action against Digicel came hours after National Commercial Bank withdrew the circular that its unvaccinated employees should start submitting a negative PCR COVID-19 test result on Wednesday in order to attend work.
 
The requirement had applied to NCB employees engaged in face-to-face and remote work.
 
The NCB Staff Association said it could not guarantee normality at the bank if the entity implemented the policy ahead of a meeting at the Ministry of Labour to discuss the matter.
