The American Civil Liberties Union (ACLU) and other groups have asked a United States federal district court in New Hampshire to ensure that children remain protected from President Donald Trump's latest attempt to restrict birthright citizenship.
On August 6, Trump signed a new executive order again targeting birthright citizenship.
But in a motion filed on Tuesday morning, lawyers for the civil rights organisations, told US District Judge Joseph Laplante, that the new order purports to strip birthright citizenship from immigrants belonging to a class they represent despite the Supreme Court's recent decision.
They wrote that to avoid any doubt in this regard, the court should underscore that the government may not strip away class members' citizenship through any executive orders or other similarly flawed assertions of Executive power over birthright citizenship.
The request from the groups is the first direct challenge to the new executive order.
