Injunction that prevented development of Bob Marley Beach lifted

Attorney-at-law Dr. Marcus Goffe

An interim injunction to prevent construction on a section of Bob Marley Beach in St. Andrew while a civil suit is being heard was this morning lifted in the Sutton Street Court.

A judge refused the application for a stay of the injunction.

Several groups including the Jamaica Beach Birthright Environmental Movement filed the civil suit on behalf of a family who reside on the property.

The campaigners have argued that development by part owners of the land leading to the beach - Woof Group Limited - will result in loss of access to the family and other beachgoers.

Dr. Marcus Goffe, attorney for the campaigners, said this is not the end of the matter.

"That was just really an injunction to remain until the court had its final decision, on the merits of the case. And so we go back to court next week on the 25th [of July] for summary judgment application before the judge to discuss the overall merits of the case for a final determination in short order," he told Radio Jamaica News

The Commissioner of Lands is also a defendant in the matter.
