Digicel gets injunction against CLARO

As the telecommunications firm Digicel Jamaica continues its legal battle with its two main rivals in the mobile industry, the company on Friday took out an injunction against CLARO.

The injunction which was granted by High Court Judge, Mr. Justice Patrick Brooks, restrains CLARO from disclosing information in relation to its 2004 inter-connection agreement with another competitor, LIME.

Digicel filed a lawsuit against CLARO in January after accusing it of sharing information with LIME.

Digicel has sued CLARO for breach of contract, breach of confidence and malicious falsehood.

Friday's injunction bars CLARO from sharing any information with LIME, until the lawsuit with Digicel is heard by the Supreme Court.

The relationship between CLARO and Digicel reportedly broke down when it began cooperating with LIME which is also locked in a fierce battle with Digicel.

Digicel has also taken out an injunction against LIME.

The injunction prevents LIME from using information surrounding a confidential network inter-connectivity agreement between Digicel and CLARO.

Digicel contends that LIME has been using information from the CLARO/Digicel agreement in its court battle with the Irish owned company.
