Opposition Leader Mark Golding says May Pen Mayor Joel Williams should step aside in light of uncertainty over his position following the People's National Party's victory in Friday's by-election in the Aenon Town division in Clarendon.
The PNP and JLP are tied with 11 electoral divisions each in the Clarendon Municipal Corporation.
Minority Leader Scean Barnswell had indicated that the PNP caucus will seek the advice of the party's attorneys to determine the next step in relation to control of the municipal corporation.
Speaking at a press conference on Tuesday morning, Mr. Golding argued that the right thing for Mr. Williams to do is to step down so that the PNP caucus can choose a Mayor. But he declined to indicate whether the PNP intends to take the issue to court, saying he was not disclosing legal strategy at this time.
JLP Deputy General Secretary Senator Charles Sinclair has said the Local Governance Act outlines that the sitting Mayor can only be removed by a vote of no confidence and where there is a tie, the Mayor will have the deciding vote.
